1. Agreement to Terms

By accessing or using Clear My Social ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms constitute a legally binding agreement between you and Social Cleaner.

2. Service Description

Clear My Social is an AI-powered social media scanning tool designed to help visa applicants identify potentially problematic content across their social media profiles. The Service scans connected social media accounts, analyzes posts using artificial intelligence, and provides risk assessments and recommendations. The Service is intended as a preparatory tool for visa applications and immigration interviews.

3. Account Requirements

To use the Service, you must:

  • Be at least 18 years of age
  • Create an account with accurate and complete information
  • Maintain the security of your account credentials
  • Only connect social media accounts that you own or have authorization to scan
  • Notify us immediately of any unauthorized use of your account

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these terms.

4. Payment Terms

Paid features of the Service are processed through Stripe. By purchasing a report or subscription, you agree to the following:

  • Pricing: All prices are listed in U.S. dollars and are inclusive of any applicable fees unless otherwise stated.
  • Payment: Payment is due at the time of purchase. Reports are delivered immediately upon successful payment.
  • Refund policy: If you are unsatisfied with your scan results, you may request a refund within 7 days of purchase, provided you have not downloaded or exported the report. Refund requests are reviewed on a case-by-case basis. Free trial usage is not eligible for refunds.
  • Promo codes: Promotional codes are single-use, non-transferable, and subject to expiration dates and conditions specified at the time of distribution.

5. Acceptable Use

You agree not to:

  • Use the Service to scan accounts belonging to other people without their explicit consent
  • Attempt to reverse-engineer, decompile, or extract the underlying algorithms or models used by the Service
  • Use the Service for harassment, stalking, or any unlawful purpose
  • Resell, redistribute, or sublicense access to the Service without our written permission
  • Interfere with the operation of the Service or attempt to gain unauthorized access to our systems
  • Submit false or misleading information to our systems
  • Use automated tools, bots, or scripts to access the Service (except as provided through our official API, if applicable)

6. Important Limitations

Please read this section carefully.

  • Not legal advice: The Service does not provide legal advice. Scan results, risk scores, and recommendations are generated by AI and are for informational purposes only.
  • No guarantees: We do not guarantee that using the Service will result in a successful visa application. Visa decisions are made by immigration authorities based on a wide range of factors beyond social media content.
  • AI limitations: Our AI analysis may produce false positives (flagging content that is not actually problematic) or false negatives (missing content that could be problematic). The system provides estimates, not definitive assessments.
  • Consult an attorney: We strongly recommend consulting a qualified immigration attorney for legal advice regarding your specific situation. Our Service is a supplement to, not a replacement for, professional legal counsel.
  • Platform limitations: Social media platforms may change their APIs, terms, or data access policies at any time, which could affect the completeness or accuracy of scans.

7. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, algorithms, and software, are owned by Clear My Social and are protected by intellectual property laws. You retain ownership of your social media content. By using the Service, you grant us a limited, temporary license to access and analyze your content solely for the purpose of providing the scan results you request.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY SCAN RESULTS OR RISK ASSESSMENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOCIAL CLEANER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. THIS INCLUDES, WITHOUT LIMITATION, ANY DAMAGES ARISING FROM VISA DENIAL, DEPORTATION, OR IMMIGRATION CONSEQUENCES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. The Privacy Policy is incorporated into these Terms by reference.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a prominent notice on our website at least 14 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately. Sections 6, 7, 8, 9, and 13 survive termination.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
